OHIO, USA — The Ohio Department of Commerce and the Ohio Department of Public Safety released a statement Friday to clarify the rules regarding the use of marijuana in establishments with liquor permits following the recent passage of Issue 2.
While Issue 2 legalized the recreational use of marijuana for adults in Ohio, the state's Division of Liquor Control emphasized that this change does not permit the use of marijuana within liquor permit holders' establishments.
According to the ODC, Ohio Administrative Rule 4301:1-1-52(B) states that no permit holder, his agent or employee shall knowingly or willfully: "Allow in, upon or about the licensed permit premises, or engage in or facilitate in, the possession, use, manufacture, transfer, or sale of ay dangerous drug, controlled substance, narcotic, harmful intoxicant, counterfeit controlled substance, drug, drug paraphernalia, or drug abuse instrument as said terms are defined in ORC Chapter 2925."
They add that liquor permit holders who knowingly or willfully allow the use of marijuana in, upon, or about their licensed permit premises are subject to administrative citation.
Bars, restaurants or any other liquor permit holders are subject to fines or possible revocation of their license.
