Man acquitted in fatal shooting outside Wendy's in Sunbury last year

SUNBURY, Ohio — A man who was charged in connection to a fatal shooting outside a Wendy's in Sunbury last year was acquitted by a jury on Wednesday, according to Delaware County court documents.

Marshle Graham was charged with one count of voluntary manslaughter on Dec. 15, 2023, after a shooting outside a Wendy's on Miller Drive.

Police were called to the restaurant for an altercation between two people outside. When officers arrived, they found one man who was shot.

The man was pronounced dead at the scene.

Sunbury Police Chief Rob Howard said Graham called into police dispatch after the incident. He was taken into custody nearby about 10 minutes after the shooting.

During Graham's trial, he moved for an acquittal but the court denied the motion, documents say.

Records state that after deliberations, the jury reached a verdict of not guilty for the charge of voluntary manslaughter. The court accepted the verdict and entered a judgment of acquittal.

There are no remaining charges against Graham.
