Former Inmate Wins Right To Sue Franklin Co. Over “Horrific” Jail Conditions

A former inmate in the Franklin County jail has won his right to sue after he says he was taunted by guards and covered in human waste for days.

A former inmate in the Franklin County jail has won his right to sue after he says he was taunted by guards and covered in human waste for days.

Robert Krutko was taken to the Franklin County Jail in November 2009 on a civil case out of Florida and was given no bond.  He says while in his jail cell with other inmates, the toilet began to overflow and when he awoke, he was covered in waste.

He and other inmates banged on the cell door for help, but says his pleas were ignored until he and other inmates began to push the waste under the door and he was released.

“During that time, the conditions were horrific,” said Krutko.

He adds that he was moved to a medical facility, where he was denied a shower and water for days, and was left to sit in his stained clothes.

Krutko sued the county after his release in 2009 over "conditions of confinement."  Last week, the U.S. Court of Appeals from the Sixth Circuit ruled the case can go forward.

However, the decision allows the county a chance to appeal to the U.S. Supreme Court, but that's unlikely.

A trial date for the civil case has not been set.
