The family of an Ohio inmate who died after being struck by lightning said Tuesday that it was suing the state Department of Corrections.

The lawsuit claims negligence contributed to the death of Dalin Anderson, 10TV News reported.

The 33-year-old was jogging in a recreation area at the Belmont Correctional Institution when he died May 31, 2010.

Five other inmates were injured in the lightning strike.

According to the lawsuit, prison personnel should have closed the exercise yard as storms approached.

The family is seeking at least $75,000 in damages.
