Exactly one year after a crash killed a 31-year-old Marion County woman, the driver of the carhas been charged.

Amber Funk was indicted on two counts of aggravated vehicular homicide and one count of drivingunder the influence, 10TV's Glenn McEntyre reported on Wednesday.

Investigators said Funk, 29, was driving at the time of a crash along state Route 203.

Ohio State Highway Patrol troopers said that on March 16, 2010, Funk went off the side of theroad, striking a cement driveway and causing the car to roll over several times.

Dawn M. Blevins, of Marion, was a passenger in the car and was killed instantly.

"They just ask where mommy's at? And I try to explain to them the best I can," said Blevins'husband, Jeff Blevins. "I mean, how do you tell a 5 year old that their mom's gone?"  Funk ranto a nearby home for help, and told authorities she was the passenger in the car, McEntyrereported.

At the time of the crash troopers said it was not immediately clear who was driving the vehicle, but investigators doubted her story from the beginning, McEntyre reported.

"It just didn't make sense that Dawn was driving, and we really did believe that Amber was, butdue to the circumstances involved we needed to wait on our evidence to come back to be able toofficially put her behind the wheel of the car," said patrol Lt. Chuck Jones.

Blevins' family said the charges bring some relief but they cannot change reality.

"Even if she gets the maximum sentence, she still has a chance to see her kids, will Dawn? Willmy kids ever see their mom again? No," Jeff Blevins said.
